1. Who We Are
The SimCase OSCE service (the "Service") is operated by SimCase SA, a company incorporated under Swiss law and registered with the commercial register of the Canton of Geneva under UID CHE-407.850.680, with its registered office at Rue du Rhône 14, c/o Walder Wyss SA, 1204 Geneva, Switzerland ("we", "us", the "Company").
These Terms & Conditions ("Terms") govern your use of the Service. By creating an account or using the Service, you agree to these Terms.
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.
3. Plans, Credits and Pricing
Access to voice simulation sessions is metered in credits. We currently offer:
- Free plan: a starting allowance of credits at signup, with no payment information required.
- Monthly and Yearly subscriptions: recurring plans with a larger credit allowance and access to the full case library and features.
- Pay-as-you-go credits: one-time credit packs that can be purchased at any time.
- Institutional plans: arranged directly with universities and teaching institutions, with terms agreed separately.
Current prices, currencies (GBP, EUR, or CHF depending on your location), credit allowances, and included features are displayed on the in-app Pricing page and at checkout. We may adjust plans and pricing; changes to a recurring subscription take effect at your next renewal, with prior notice. Credits obtained through the referral program are subject to fair use and may be adjusted or revoked in case of abuse.
4. Payment, Renewals and Cancellations
- Payment processing: Payments are processed by Stripe. We do not store your card details. Applicable VAT or sales tax is calculated and shown at checkout.
- Billing: Subscriptions are billed in advance, monthly or yearly. Pay-as-you-go credit purchases are one-time charges.
- Recurring payments: Subscriptions renew automatically unless cancelled before the renewal date.
- Cancellation: You may cancel at any time via your account (billing portal). Cancellation takes effect at the end of the current billing cycle; you keep access until then. No refund is given for the remaining period.
- Refunds: Payments are non-refundable except where required by law. Unused credits are not refunded. If you are a consumer residing in the EU or UK, you have a 14-day right of withdrawal for digital services; by starting to use the Service (consuming sessions or credits) during that period, you expressly consent to immediate performance and acknowledge that the right of withdrawal is lost or reduced accordingly.
5. Educational Use Only: Not Medical Advice
The Service provides simulated clinical encounters for training and examination practice. You acknowledge that:
- During sessions you are conversing with an AI-simulated patient, not a real person.
- The Service, including AI feedback and evaluations, is not medical advice, diagnosis, or treatment and must not be used to make decisions about real patients.
- The Service is a study aid and is not a substitute for real-life clinical training, supervision, or professional judgment.
- You must not enter real, identifiable patient data into the Service.
- AI-generated content and evaluations may contain inaccuracies. Scores are indicative learning feedback, not an official examination result.
6. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all activity under your account. You agree not to:
- Use the Service in violation of any law or regulation.
- Transmit harmful, offensive, or objectionable content.
- Attempt to reverse-engineer or disassemble the Service.
- Interfere with normal operation or bypass security features.
- Share your account or circumvent credit limits or plan restrictions.
7. Prohibited Conduct with AI Agents
- Insulting or Abusive Behavior: No abusive, harassing, discriminatory, or offensive content.
- Prompt Hijacking: Do not manipulate prompts to subvert AI behavior.
- Malicious Intent: Do not harm platform reputation, performance, or security.
8. Your Content
Cases you create with the Case Builder are private to your account. You retain ownership of content you create; you grant us a non-exclusive license to host and process it solely to provide the Service. We may remove content that violates these Terms.
9. Privacy & Data Protection
By using the Service, you acknowledge that your interactions (including speech, transcripts, and related analytics) are collected and processed to provide feedback, analytics, and platform functionality. We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (FADP), as described in our Privacy Policy. In particular:
- Application data is hosted in the European Union (Paris, France region); audio recordings are stored in the EU (Cloudflare R2).
- Audio recording is optional: it is off by default and happens only with your explicit consent, which you can also confirm or decline per session. You can delete all your recordings at any time from your account.
- We rely on third-party providers to operate the Service, including OpenAI, Mistral AI, and Google (AI and voice processing), LiveKit (real-time audio), Cloudflare (EU storage), Stripe (payments), Postmark and Brevo (email), and Google Analytics (only after cookie consent).
- You can export your data (a download link valid for 48 hours), correct your profile, or delete your account and recordings directly from your account settings, or by contacting [email protected].
- Your data is not sold to third parties. You may lodge a complaint with your local supervisory authority, for example the FDPIC in Switzerland or the ICO in the UK.
Important: You may disable audio at any time. We do not store biometric identifiers.
10. Intellectual Property
All platform content, case library materials, AI configurations, software, and functionality are the property of SimCase SA or its licensors. You may not reproduce, distribute, or modify them without explicit permission.
11. Termination
We may suspend or terminate your access at any time if you violate these Terms or if necessary for legal, technical, or security reasons. You may delete your account at any time from your settings.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free, or that AI output will be accurate.
13. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
14. Modifications to Terms
We may revise these Terms at any time by posting an updated version on our website and, for material changes, notifying you. Your continued use of the Service constitutes acceptance of the updated Terms.
15. Governing Law and Disputes
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them are governed by Swiss substantive law, excluding its conflict-of-laws rules.
If you are a consumer, you additionally benefit from any mandatory consumer-protection provisions of the law of your country of residence, and nothing in these Terms affects your right to rely on them or to bring proceedings before the courts of your domicile where mandatory law so provides.
Subject to the above, the courts of Geneva, Switzerland have jurisdiction to settle any dispute or claim.
